JUUL was founded four years ago with a promise it could help smokers quit. It quickly spawned the vaping movement. Over the course of the last year, high school students experienced a 78% surge in e-cigarette use, according to a report by the CDC. Successful marketing to minors, coupled with the current mystery vaping lung diseases, have left the electronic cigarette giant in crisis. E-cigarettes and weed vape pens have now been linked to more than 805 hospitalizations and 18 deaths (and counting) according to the Centers for Disease Control and Prevention. Formation of JUUL MDL
In July 2019, JUUL Labs, the leading manufacturer of e-cigarette products, filed a motion with the U.S. Judicial Panel on Multidistrict Litigation (JPML) to consolidate all federally filed JUUL lawsuits into one court, requesting the Northern District of California. The JPML listened to arguments on the issue on September 26, 2019.
On October 2, 2019 the JPML issued the MDL 2913 transfer order, consolidating the JUUL vaping injury docket in the U.S. District Court, Northern District of California in front of Judge William H. Orrick III in San Francisco. The panel assigned Judge Orrick to preside over the litigation since he currently presides over the existing California JUUL lawsuits.
Right around the same time, mere days ago, the Food and Drug Administration issued a MedWatch Safety Alert, strengthening its warning to consumers to stop using vaping products amid more than 1,000 reports of lung injuries—including some deaths—following the use of vaping products.
The JUUL MDL lawsuits include not only injury and death claims, but also class actions alleging JUUL’s misleading marketing failed to disclose the nicotine in its products, causing young adults and teenagers to get addicted. The injury claims are mainly focused on pulmonary disease, seizures, and other serious health problems.
