Drunk Driver Found Asleep Behind The Wheel

A drunk driver was arrested in Houston this past weekend for falling asleep behind the wheel while driving. He tried to drive away, but crashed shortly thereafter. Driving while intoxicated (DWI) means your blood alcohol concentration (BAC) level is 0.08% for drivers 21 and older or any detectable amount for drivers under the age of 21.

Drunk driving is a crime. With the proper evidence, the police can arrest offenders and prosecutors can bring a case against them in criminal court. While a criminal case can bring justice, it does not offer the victims of drunk driving accident injuries any compensation. In addition to criminal charges that can include Driving While Intoxicated (DWI) and Driving Under the Influence (DUI) penalties, if a drunk driver injures someone, he or she can file a civil lawsuit for personal injury.

And, since a person is more likely to be seriously hurt in a car wreck than in any other activity, adding alcohol into the mix only makes motor vehicle crashes that much more dangerous. Alcohol-related accidents account for the majority of serious injuries and fatalities on Texas highways.

Who Can Be Sued?

One of the key factors in serious drunk driving accidents is to determine where and how the drinking driver got drunk because many times other potential defendants can be pursued in addition to the drunk driver. “Dram Shop” laws allow a person injured by a drunk driver to sue the venue that served the drunk driver.

The Texas Dram Shop Act holds establishments and/or social hosts responsible when they provide alcohol to guests and an intoxicated guest causes injuries. The law spells out that those who serve liquor can neither continue to serve alcohol to visibly intoxicated patrons, nor allow visibly intoxicated individuals to drive away from their place of business.
