Fatigued Driving Causing Devastating Truck Accidents

Fatigued Driving Accident Attroney

Every day, millions of Americans share the roads with large trucks. These giant vehicles help stock the grocery store shelves and carry goods to their final destinations. Although these vehicles are absolutely necessary for transportation, they are fraught with dangers. Because of their size and weight, they can easily cause devastating roadway accidents. This makes it extremely important for truck drivers to be alert and ready to respond to changing road conditions and hazards. Unfortunately, many truck drivers are driving while fatigued and causing fatal accidents.

FMCSA Hour Regulations

The Federal Motor Safety Carrier Safety Administration (FMCSA) has set strict hour regulations regarding how many hours truck drivers can work. This is incredibly important because when drivers are fatigued they have slower reaction times, impaired judgment, and can even fall asleep at the wheel. FMCSA working hour regulations for truck drivers state that:

  • Drivers can drive a maximum of 11 consecutive hours, but only after a full 10 hours off duty
  • Drivers must take a 30 minute break at least every eight hours
  • Drivers must not drive more than 60 hours in seven consecutive days or 70 hours in eight consecutive days
  • After a driver has met their maximum hours for the week, they must take at least 34 consecutive hours off-duty

While these working hour regulations can greatly help reduce the number of truck accidents, they only work if they are followed. Some drivers choose to ignore FMCSA regulations. Trucking companies often set hard deadlines and truck drivers might feel the pressure to ignore FMCSA regulations in order to meet them. This can prove particularly devastating, considering truck accidents are more likely to cause a fatality to passenger vehicles than the truck driver. There is no excuse for fatigued driving. Both truck drivers and trucking companies have a responsibility to operate safely. When they refuse to do so, they can be held accountable for the resulting damage.
